Terms, Platform Agreement & SMS Program Terms

Part I covers everyone who uses this website or receives our text messages. Part II is the platform agreement that applies to real-estate professionals who join Selah Creative. If you have signed a separate written agreement with Selah Creative, that signed agreement controls wherever the two differ.

Part I — Site use & SMS program

SMS program description

The Selah Creative text-message program sends service-related messages to people who opt in on our websites or the agent websites we operate: things like event registration details (for example, a Zoom link you requested), follow-ups about a real-estate inquiry you submitted, appointment and response reminders, and service alerts for the agents on our platform.

Opt-in

You opt in by submitting a form where you provide your mobile number and check a consent box agreeing to receive text messages from Selah Creative (or by texting us first). Consent is not a condition of any purchase. We only text people who asked to hear from us.

Message frequency & rates

Message frequency varies based on your inquiry or registration. Message and data rates may apply according to your mobile plan. Carriers are not liable for delayed or undelivered messages.

Opt-out (STOP) and help (HELP)

Reply STOP to any message to cancel and stop receiving texts from us — you'll receive a single confirmation message. Reply HELP for assistance, or contact support@selahcreative.media.

Privacy

How we handle your information — including our commitment that no mobile information is shared with third parties or affiliates for marketing or promotional purposes — is described in our Privacy Policy.

Use of the site

Selah Creative provides websites, marketing, visibility and lead services for real-estate professionals. Content on this site is provided in good faith and for general information; it is not legal or financial advice. Real-estate services are performed by independent licensed agents and brokerages, not by Selah Creative.

By using this site you agree not to misuse it (including scraping, spamming our forms, or attempting to disrupt the service). We may update these terms; the "Last updated" date above reflects the current version.

Part II — Platform agreement for agents

This part applies to licensed real-estate professionals who purchase the Selah Creative platform ($100/month plus a one-time $150 setup fee, unless your signed agreement says otherwise). Agents who join during the founding period keep the $100 monthly rate for as long as they remain continuously enrolled; the standard rate is $175/month for agreements starting on or after October 1, 2026. A lapse in enrollment ends the founding rate, and rejoining is at the rate then in effect.

1. What the platform includes

A website built and operated for you in your brand, search and AI-search visibility work, done-for-you marketing, exclusive vetted seller leads, and a private lead portal. There are no per-lead charges and no advertising budget requirements.

2. What qualifies as a "Selah lead"

A Selah lead is any prospective client that reaches you through the platform, specifically:

Every Selah lead is recorded in our system with a delivery timestamp at the moment it is dispatched or captured. It remains a Selah lead no matter which channel you and the client use afterward — phone, text, email, or in person — and regardless of which property they ultimately transact on.

Drive for Dollars results are provided for your own listing outreach only — not for resale or bulk marketing. They carry no 48-hour contact clock, and like every Selah lead the referral fee applies only if the property ends in a closed transaction with you.

3. The referral fee — and when it is earned

Our monthly price stays low because Selah's real compensation is a referral fee of 20–25% of the gross commission payable to your side of the transaction (the exact rate is set in your onboarding agreement) when a Selah lead closes. The fee is earned only at closing: if a Selah lead never closes a transaction with you, no referral fee is ever owed. The fee applies when the closing occurs within 24 months of the lead's delivery date.

Referral arrangements and compensation are administered through the appropriately licensed brokers and approved payment entities, in accordance with New Jersey law. Selah Creative LLC is registered with the New Jersey Department of Banking and Insurance (Entity Reg. 01394) for the receipt of referral compensation. Participating agents remain under the supervision of their respective brokerages, and by joining you confirm your broker has approved the arrangement.

Where possible the referral fee is settled at closing through the brokerages. Otherwise, Selah invoices the fee once the commission is received, due within 15 days. If you believe a fee was charged in error — for example, the closing did not involve a Selah lead — raise it in writing within 30 days and we will resolve it in good faith with the records on both sides.

6. Duplicates and pre-existing relationships

If a delivered lead is someone you already had a documented relationship with — a prior signed agreement, a past transaction, or correspondence pre-dating the delivery timestamp — flag it within 7 days of delivery with the documentation. The lead is excluded from referral obligations and we replace it. If the same person is ever delivered twice, they count once, from the first delivery.

Joining Selah is a 12-month commitment: the initial term runs twelve months from your start date, and the monthly fee is owed for that full term even if you stop early. After the initial term, the platform continues month-to-month and you may cancel with 30 days' written notice. The setup fee and fees already paid are non-refundable. When the platform ends, future lead deliveries and monthly charges stop. The referral obligation on leads already delivered survives: if a Selah lead closes with you within its 24-month window, the referral fee is still owed.

9. Service levels, warranties, and honest limits

We operate the platform with commercially reasonable skill and care, aim to keep your site and portal available around the clock, and answer support requests within one business day. What we do not promise: a specific number of leads, that any lead will respond or transact, or specific search rankings — markets, inventory, and seasons vary, and anyone who guarantees closings is not being honest with you. Except as stated here, the services are provided "as is."

10. Liability and governing law

To the extent the law allows, Selah Creative's total liability for any claim related to the services is capped at the fees you paid in the twelve months before the claim, and neither side is liable for indirect or consequential damages. These terms are governed by New Jersey law, with venue in Bergen County, New Jersey.
